We want to be sure your photography experience is nothing less than exceptional. We have provided this photography contract for your review so that you are fully aware of the terms and conditions of each photography session before you pay the retainer.
THE FIRST STEP TO SECURE AN APPOINTMENT IS TO PAY A RETAINER / DEPOSIT :
Paying the retainer fee will guarantee your appointment and put you at the top of the scheduling list.
If a service or product increases in price, you will not incur any price increase. It will keep you at the current pricing structure.
The retainer will be deducted from the total collection price.
The retainer is non refundable unless the appointment is cancelled within 72 hrs or in the event of an emergency.
CONSULTATION:
After paying the retainer fee we will contact you within 24-48 hrs to schedule your consultation. During your consultation we will discuss planning details as well as setting the dates for the balance payments to be made.
COLLECTION BALANCE:
The collection balance is due 3 days prior to your session appointment.
SESSION DAY TERMS:
Clients arriving more than 15 mins late may not be guaranteed the same number of images from the selected digital collection and a discount will not be given.
Clients 30 mins or later will be rescheduled with an additional $50 fee for the inconvenience.
If you or your children are sick, please give 24 notice and we will reschedule at no additional charge. If you arrive and have an apparent illness (presenting cold like symptoms; sneezing, coughing, ect) you will be asked to leave. If you arrive with a sick child, you will be asked to leave. It is a health risk to have sick children in our studio as we have many maternity and newborn clients visit during the week as well as Diane Yvon being a NICU and birth photographer she herself cannot be exposed to sick children.
Taking pictures or recording with cameras or phones are not permitted at any time during the session as they are disruptive to the process.
Please do not ask to see the images in camera during the session as it delayed the process.
AFTER THE SESSION - IMAGE PREVIEW & VIEWING:
The day after your session we will provide 1-3 images for sharing. Depending on the collection you chose and the editing needs it will be 3 - 14 days to view the final gallery.
IMAGE SHARING & PRIVACY:
We ask that you be open to allowing us to share images from your session. Images are often used online or in print to show current work. Actual identities can be kept private and cropping out facial identity can be arranged. A final image Usage Release Contract must be digitally signed with the right to privacy in the terms.
ORDERING SESSION:
Your image gallery reveal and ordering session will take place 2 weeks after your session. Please be sure the decision makers are present at the ordering session as there is an additional $25 fee to repost an online gallery after it expired. Online ordering is available with your online gallery, it expires 2 weeks after your image reveal appointment. (belly2baby clients have an extension to the final newborn session) Family and freinds may order form the online gallery. All orders must be paid in full at the ordering session. 15% off is granted at the 1st order and all others following are at full retail price. Please respect that prices are non negotiable.
Images are available for 6 months after your image gallery reveal, after that time they are archived. Ordering after this time will result in a $50 add on fee to retrieve digital files from storage.
LIABILITY WAVIER:
In the unlikely event of a memory card error resulting in damaged files the retainer fee will be refunded and a reshoot will promty occur at no cost to you.
DAMAGE WAVIER:
You will be held financially responsibly if your child or pet damages studio equipment or gear due to unsupervised children and pets. It is best to arrange for a family member or friend to stay and supervise your child or pet or to pick them up once their portion of the session has taken place.
COPYRIGHT:
Diane Yvon Photography & Mama & Me Photography Spa retains the ultimate copyright to all digital image files. Clients receive a print release for images to be printed for personal use only. Digital image files or prints from those files may not be used for commercial purposes, sold or assigning to any 3rd party, altering of image files is prohibited, and clients may not enter any image into a print competition without written consent of the studio. We have a business attorney who will prosecute violators of our copyright terms.
COPYRIGHT: IMAGE USAGE TERMS:
You do not receive a transfer of copyright ownership as we retain the ultimate copyright. Images may not be used for resale, digitally, via print, in a painted art form or by any duplication on a product of any kind without written permission.
Images may not be used in templates for previews or resale on any business website or their social media outlets.
Images may not be claimed as someone else's work or entered into competition without written permission.
Images may not be placed on any social media commercial account, business site, or social media influencer site without our logo such as: instagram, facebook, twitter, vlogs, blogs, pinterest, or any other business social media outlet.
You may place your images, without our logo, on your own personal social media sites. If your logo free image or post is shared on a business outlet we are to be informed and tagged as the creator.
Images with our logo may not be altered or color edited in any way. You may alter or color edit your logo free images for personal use only. If you alter or color edit an image we will not be responsible for the print quality of the image.
COPYRIGHT: PRINT TERMS: This print release is for unlimited personal self printing with any lab of your choice. You may print digital image files without our logo for personal use only such as /divdivfor print & print products to display in your home, office or for gift giving. We can only guarantee the quality seen in our studio when printing with our lab.
PRINT SIZE DETAILS: The largest available print size will be noted in the file name: (example: 1c_print upto20x16.jpg) You may request an image to be up-sized at no charge. /divdivContact us with the session date & file name and if the image file size can be increased will provide it.
COLOR PROFILE: Images are embedded with sRGB color space profile.
